This document is a working draft prepared for internal review. It should be reviewed and approved by qualified legal counsel — particularly with respect to CCPA, GDPR applicability, and payment data handling — before publication. It does not constitute legal advice.
STIMP Inc. (“STIMP,” “we,” “us,” or “our”) operates the STIMP platform, including stimpclub.com and any related applications and services (the “Platform”). This Privacy Policy explains what information we collect, how we use it, with whom we share it, and the choices you have regarding your information. By using the Platform, you agree to the collection and use of your information as described in this Privacy Policy. This Policy is incorporated into and subject to our Terms of Service.
1. Information We Collect
1.1 Information You Provide Directly
When you create an account, apply for membership, or use the Platform, you may provide:
- Account information: name, email address, username, and password
- Profile information: golf handicap index (GHIN), home club affiliation, and any other details you choose to add to your profile
- Course and club data: course ratings, rankings, tags, notes, and round history you log through The Scorecard
- Club fee data: private club fee information you voluntarily contribute to The Index
- Communications: messages, support requests, or other correspondence you send to us
- Referral information: the name and email address of individuals you refer to the Platform
- Payment information: billing details provided when purchasing a membership (processed by our third-party payment processor; we do not store full payment card numbers)
1.2 Information Generated by Your Activity
As you use the Platform, we collect information about how you engage with it, including:
- Courses you've logged, ratings you've submitted, and rankings you've created
- Connections you've made and referrals you've sent
- Your STIMP Score and the activity that contributes to it
- Features you use and how frequently you use them
- The date and time of your activity on the Platform
1.3 Technical Information
When you access the Platform, we automatically collect standard technical data, including:
- IP address and approximate location derived from it
- Browser type and version, operating system, and device type
- Pages viewed, links clicked, and referring URLs
- Cookies and similar tracking technologies (see Section 6)
1.4 Information from Third Parties
If you connect a third-party account (such as a GHIN handicap verification service) to your STIMP profile, we may receive information from that service consistent with your authorization and their privacy practices. We do not control third-party data practices.
2. How We Use Your Information
We use the information we collect to:
- Create and manage your account and provide access to Platform features
- Operate The Index, The Scorecard, and The Clubhouse as described in our Terms of Service
- Display your course ratings and contributions to other users where applicable (see Section 3)
- Calculate and update your STIMP Score
- Process membership payments and manage billing
- Review and process referrals and membership applications
- Send transactional communications: account confirmations, application status updates, billing notices, and security alerts
- Send promotional communications about STIMP features, updates, and events (you may opt out at any time)
- Improve the Platform through analytics and user feedback
- Detect, investigate, and prevent fraud, abuse, and violations of our Terms of Service
- Comply with applicable legal obligations
3. How We Share Your Information
3.1 With Other Users
Certain information is visible to other users of the Platform by design:
- Your profile name and public profile details are visible to other members
- Course ratings, STIMP Ratings, and tags you submit contribute to composite scores and may be visible to other users in aggregate or individual form, subject to your privacy settings
- Activity in The Clubhouse, including connections and participation in the member network, is visible to other Clubhouse members
- Club fee data you contribute to The Index is made available to other verified members who have also contributed data, as described in our Terms of Service
3.2 With Service Providers
We share information with trusted third-party vendors who help us operate the Platform, including:
- Cloud hosting and infrastructure providers
- Payment processors (who handle billing data under their own PCI-compliant security standards)
- Email and communication service providers
- Analytics providers who help us understand Platform usage
These providers are contractually obligated to use your information only to provide services to us and to maintain appropriate security standards.
3.3 For Legal Reasons
We may disclose your information if we believe in good faith that disclosure is necessary to comply with a legal obligation, respond to a valid legal process, protect the rights or safety of STIMP or others, or enforce our Terms of Service.
3.4 Business Transfers
If STIMP is involved in a merger, acquisition, asset sale, or similar transaction, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on the Platform before your information becomes subject to a different privacy policy.
3.5 What We Do Not Do
We do not sell your personal information to third parties. We do not share your personal information with advertisers or allow third parties to use your data for their own advertising purposes.
4. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Platform and comply with our legal obligations. If you close your account, we will delete or anonymize your personal information within a reasonable period, except where we are required to retain it by law or where retention is necessary to resolve disputes or enforce our agreements. Contributed club fee data and course ratings may be retained in anonymized or aggregated form after account deletion, as they form part of the Platform's community database.
5. Your Choices and Rights
5.1 Account Information
You may review and update your account information at any time through your profile settings. You may request deletion of your account by contacting us at admin@stimp.club.
5.2 Communications
You may opt out of promotional emails at any time by clicking the unsubscribe link in any promotional message or by contacting us directly. You cannot opt out of transactional communications (such as billing notices or security alerts) while your account is active.
5.3 California Residents — CCPA Rights
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):
- The right to know what personal information we collect, use, disclose, and sell
- The right to request deletion of your personal information, subject to certain exceptions
- The right to opt out of the sale of your personal information (note: we do not sell personal information)
- The right not to be discriminated against for exercising your privacy rights
To exercise these rights, contact us at admin@stimp.club with the subject line “CCPA Request.” We will respond within 45 days as required by law. We may need to verify your identity before processing your request.
5.4 Users Outside the United States
The Platform is operated from the United States and is intended primarily for U.S. users. If you access the Platform from outside the United States, your information will be transferred to and processed in the United States. By using the Platform, you consent to this transfer. If you are located in the European Economic Area (EEA) or United Kingdom and believe GDPR or UK GDPR applies to your use of the Platform, please contact us at admin@stimp.club. We will work to address your request in accordance with applicable law.
6. Cookies and Tracking Technologies
We use cookies and similar technologies to operate and improve the Platform. Cookies are small text files stored on your device that help us recognize you, maintain your session, and understand how you use the Platform. We use the following types of cookies:
- Essential cookies: required for the Platform to function, including authentication and session management
- Analytics cookies: help us understand how users interact with the Platform so we can improve it
- Preference cookies: remember your settings and preferences
You can control cookies through your browser settings. Disabling essential cookies may prevent parts of the Platform from functioning correctly. We do not currently respond to “Do Not Track” signals, but you may opt out of analytics tracking by contacting us.
7. Data Security
We implement reasonable technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These include encrypted data transmission (HTTPS), access controls, and secure infrastructure hosting. No method of transmission over the internet or electronic storage is completely secure. While we work hard to protect your information, we cannot guarantee absolute security. If you believe your account has been compromised, contact us immediately at admin@stimp.club.
8. Children's Privacy
The Platform is not directed to individuals under the age of 18, and we do not knowingly collect personal information from children. If we become aware that we have collected information from a child under 18, we will take steps to delete it promptly. If you believe a minor has provided us with personal information, please contact us at admin@stimp.club.
9. Third-Party Links and Services
The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you access through the Platform.
10. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page. For material changes, we will notify you by email or through a prominent notice on the Platform prior to the change taking effect. Your continued use of the Platform after any update constitutes your acceptance of the revised Policy.
